1. Accepting these terms
These Terms & Conditions apply to your use of the MTO Bar & Grill website and to orders you place with us online. By using this website or placing an order, you agree to these terms. If you don't agree, please don't use the website; you're always welcome to call or visit us instead.
2. Online ordering
Our "Order Now" buttons take you to our online ordering page, which is provided by TableTeq, a third-party ordering platform. When you order there, you're also subject to that platform's own terms of service and privacy policy. We are responsible for preparing your food; the platform is responsible for operating the ordering and checkout technology.
An order is accepted once you receive a confirmation. We may decline or cancel an order, for example if an item is unavailable, the kitchen is at capacity, we're about to close, or the order appears fraudulent. If we cancel an order you've paid for, you'll receive a full refund.
3. Prices & availability
The menu shown on this website is for general reference. Prices, specials and item availability on the online ordering page at the time you order are the ones that apply. Prices may change without notice and may differ from in-restaurant prices. Applicable Ohio and local sales tax is added at checkout. We do our best to keep everything accurate, but if an item is listed at a clearly wrong price, we may cancel that item or contact you before preparing the order.
4. Payment
Online payments are processed by the ordering platform and its payment processors. MTO Bar & Grill does not receive or store your full card number. By submitting payment, you confirm you're authorized to use that payment method.
5. Pickup & order accuracy
- Ready times shown at checkout are estimates and can change during busy periods.
- Please check your order before you leave. If something is missing or wrong, tell a staff member or call us at (937) 444-3500 as soon as possible and we'll work to make it right.
- Food is prepared to be eaten promptly. We aren't responsible for the quality of food that is left unattended or picked up long after the ready time.
6. Cancellations & refunds
If you need to change or cancel an order, call us right away. Once we've started preparing your food, we may not be able to cancel it or offer a refund. If there's a problem with your order, contact us the same day; refunds, credits or replacements are at the manager's discretion.
7. Alcohol
Alcoholic beverages are only sold and served to guests who are 21 years of age or older, in line with Ohio law. Valid government-issued photo ID is required and will be checked. We may refuse service to anyone who cannot show valid ID or who appears intoxicated. Any alcohol sales, including carryout where permitted, are subject to Ohio Division of Liquor Control rules. Please drink responsibly and never drink and drive.
8. Allergens & food safety
Our kitchen handles common allergens, including milk, eggs, wheat, soy, peanuts, tree nuts, fish and shellfish. Because we share cooking surfaces and fryers, we cannot guarantee that any item is free from allergens. If you have a food allergy, please call us before ordering so we can talk through your options.
Consumer advisory: Consuming raw or undercooked meats, poultry, seafood, shellfish or eggs may increase your risk of foodborne illness, especially if you have certain medical conditions.
9. Website content
The MTO Bar & Grill name, logo, photos and text on this website belong to MTO Bar & Grill. You may view and share pages for personal, non-commercial use, but please don't copy or reuse our logo or content for commercial purposes without our written permission. Links to other websites (such as the ordering platform or maps) are provided for convenience; we don't control those sites.
10. Disclaimers & liability
This website is provided "as is." We try to keep it accurate and available, but we don't promise it will always be error-free or uninterrupted. To the fullest extent allowed by law, MTO Bar & Grill is not liable for indirect or consequential damages arising from your use of the website or the ordering platform, and our total liability for any order is limited to the amount you paid for that order. Nothing in these terms limits any rights you have under Ohio consumer protection law that cannot be waived.
11. Governing law & changes
These terms are governed by the laws of the State of Ohio. Any dispute will be handled in the state or federal courts serving Brown County, Ohio. We may update these terms from time to time; the "Last updated" date at the top of this page shows when they last changed.
